TYPES OF LICENSES
I have serval different licenses which you can view below, depending on how the artwork I create can be used.
Requested, commercial and full licenses come with a separate terms and conditions which has to be agreed upon.
These terms can be discussed and I will send a personalised terms and conditions to agree with the client.
Commissions and work such as gifts, art trades etc which do not have a specific terms and conditions are labelled under personal use which can be read below.
By using my work you are agreeing to the terms and conditions.
By commissioning me you are either agreeing to my personal use terms and conditions or custom commercial terms.
Please see commercial and full licenses for more information on specific terms and conditions to the client's needs.
Standard Terms and Requested Use
Personal use is not automatically given to general artwork that I create or artwork which has not been made specially for you or another person. This type of artwork typically comes under original art which means it has been made from my original ideas, stories and creations.
All my artwork unless made for someone or commissioned automatically is not to be reposted, trace, edited, adding or use of filters, recoloured or used commercially. I do not allow my art to be used by or for AI purpose.
If I see the use of AI on my artwork I will ask for the removal of the AI post / picture / video / product / content and I have the right to take legal action. Use of AI involved with my artwork will place the client / user in my black list where I will not work with the person again, this is as it is disrespectful to use AI on / with my artwork without permission.
You do not have any rights to any of my artwork which has not been made for you unless I have given you permission.
You will have to specifically ask my permission to repost my art or use it for your intention (which must be stated).
This is a request in which I may allow you to repost or use my work under personal use for a limited time or one off which has been agreed upon.
I am allowed to refuse your request to use my artwork.
This may not be requested for artwork which has specifically been made for someone (Example: DTIYS, Art Trade, Art Request or Gift) or commissioned by a client.
An example of how to ask for requested use of my artwork:
May I use your artwork “link to art or name of art here” to repost to my page (please state where you wish to post) as a one off? I will credit you properly in the description including a tag or link to your account.
This type of request is typically used to promote artwork of the artist.
The individual requesting may not use the artwork for commercial use or earn money from the artwork. They also may not recolour, trace or edit my artwork in their post.
My artwork may not be used by the individual in a post / video which includes sponsored content or in an advert.
My artwork may not be used to promote events, charities, companies, indivuals without requested permission.
Failure to keep to the terms agreed upon may result in legal action and I have the right to file to take down posts / videos / content / products which contain my artwork or use of my artwork.
If my artwork is reposted, edited, used by or for AI purposes, traced, recoloured, commercially used without my permission I have the right to take legal action and file to take down posts / videos / content / products which uses my artwork or use of my artwork.
Educational Use
You may use my art style to study from, you may upload that art to the internet but I as the artist must be credited for the reference of the art study. You may not use the art study for commercial use. This also does not allow the use of tracing of my art, Educational use is only to study my art style purely for educational purposes. You may not claim the directly studied art style as your own, it is heavily encouraged that you develop your own work and art style, please study from many artists and develop your own work and art style.
Educational Use of my art should not repost, trace, edit, add or use of filters, Recolour my own artwork or direct copies of my artwork, this may also not be used commercially.
I do not allow my art to be used by or for AI purposes. I do not count the use of AI training or art alternation by or for AI purposes as educational use.
Stealing art well as editing, recolouring or tracing my artwork is considered art theft and I have the right to take legal action and file take down of posts / videos / content / products which display art theft of my artwork.

Private / Personal Use
All art that I create for a person automatically has a personal use license. This includes work listed as a Gift, Fan art, Art trade or Commission (which has not been made for a commercial license).
To see commercial license please scroll down the page to the commercial license section.
A commercial license must be requested and agreed upon before I start the commission.
A personal use license will not expire, however a commercial license may expire based on negotiation.
If you are unsure if you would like a commercial license currently, but you may want to in the future you must make me aware of this before I start your commission. You may not use my work commercially until the commercial license has been bought.
In this case commercial use license would also need to be read by the client before I start the commission.
You may come back to me in the future and buy the commercial license for when you need it.
Commercial license is not refundable.
Personal Use does not allow the commissioner / client to have any commercial rights of the artwork created. This means that the commissioner / client may not sell or commercially use the art piece.
Personal use includes not being able to use the artwork for charity work or merchandise even if you are not making money.
Personal use artwork should also not be used in advertisement, promotional or sponsored content.
Please feel free to contact me if you wish to work with a charity or use my art to promote anything.
Changing and editing your personal use commission.
I do not allow the use of tracing, editing, recolouring, adding or use of filters, AI purposes to be used for personal use commissions and artwork.
If you would like your commission or art piece received to be edited or changed please feel free to contact me and I will ask for a donation for the changes you wish to add / remove from your commission. Please note that my commissions are roughly priced about £10 per hour as by min wage for 23 year olds + in the UK, so please bare this in mind when donating for changes and asking for what changes you wish for.
I (The Artist) am allowed to post the artwork crediting the client and use the artwork in my portfolio.
Personal use allows the client to post the artwork to social media.
All personal use artwork must be credited properly.
How to credit:

Credit must be listed in the post / video / content description, description when art when is posted.
For a profile picture I must be credited in the bio.
Example for an online post may include my name (J.L.Phillips) and tag (@JLPhillipsCreations) under Artist.
Personal use comes with watermarked artwork that may not be removed, cropped, covered or edited.
Watermark must be visible in the post / video / content.
Commerical Use
Starting price at £300 Or 10% of sales.
Final price will be negotiated with client and may vary due to commission.
Standard Commercial use allows the client (commissioner) to use the commissioned art piece for commercial use and allows them to make money with the artwork commissioned, however I (the Artist) must be credited and I may post the commissioned art to my own art page and use it in my portfolio.
This commercial license allows the artwork created for the client to be licensed for particular uses.
This means that the client is able to select their specific uses of the artwork.
Examples of specific uses of the artwork: a book cover, album cover, magazine article, magazine cover, T-shirt, mug etc.
This is agreed upon in the price of the licence.
The intended use for the commission must be stated before I start the commission so that I can effectively create the artwork for the clients needs.
The client must request the exclusivity of the license and for how long they wish to have the license.
Example of exclusivity: If the artwork can be used by multiple people or if the artwork can only be used by the client and how long for.
A commercial license may expire based on negotiation.
The client may request full exclusivity which means that only the client may use the artwork.
Clients may request lifetime commercial use of the commission.
If an expiry date has been negotiated, upon expiry the rights fall back to I (The Artist).
I must still be credited as the Artist of the commission while the client uses it.
The client may not sell the commercial license to another person of the artwork commissioned.
Artwork with commercial use license may not be used by or for AI purposes.
In the UK art is automatically copyrighted and lasts for the Artist’s lifetime plus 70 years after their death. Then it becomes public domain. It is the clients responsibility to protect the copyright for the commissioned piece for the time they have purchased the license and to copyright the artwork, if in another country that requires different copyright laws.
Commercial use pricing for commissions starts at £300 and will be negotiated upon, this may range from use and complexity of commission.
The price and commercial uses will be agreed upon before starting the commission.

Example: A book cover must have my name (J.L.Phillips) and tag (@JLPhillipsCreations) credited in the book under Cover illustration.

Changing and editing your commercial use commission.
I do not allow the use of tracing, editing, recolouring, adding or use of filters, AI alternation or training to be used for commerical use commissions and artwork.
If you would like your commission or art piece received to be edited or changed please feel free to contact me and I will ask for a donation for the changes you wish to add / remove from your commission. Please note that my commissions are roughly priced about £10 per hour as by min wage for 23 year olds + in the UK, so please bare this in mind when donating for changes and asking for what changes you wish for.
Commercial use artwork comes with and without a watermark for the client to use.
Commercial license is not refundable.
Full License Use
Starting price at £1,000
Full commercial license is when the client (commissioner) receives all full rights to the commissioned art piece.
I (the Artist) may not use or post the artwork without permission from the client. I will not be able to advertise and share the commission without the clients permission to do so.
Full license also includes that the client may have full rights of the commissioned art piece for their lifetime.
If commissioned for a company, then for the company’s lifetime.
The commissioned piece may not be used after the lifetime of the client / company unless agreed upon who may own the commercial full license afterwards, for the art piece by the original client / company.

The price for full license will be agreed upon before starting the commission.
Full license may not be purchased later and must be agreed upon when the commission is requested. This is to avoid me using the work for my portfolio or posting it online so the client does not have to request the take down of the commission that I may have posted if it was previously commercial or personal use.
I do allow the use of editing to be used for full license commissions and artwork.
However if you would like your commission or art piece to be edited or changed by me, please feel free to contact me and I will ask for a donation for the changes you wish to add / remove from your commission. Please note that my commissions are roughly priced about £10 per hour as by min wage for 23 year olds + in the UK, so please bare this in mind when donating for changes and asking for what changes you wish for. It is very appreciated that you come back to me for any changes made to the art piece.
The art piece comes without a watermark.
Full license is not refundable.
Full license puts me in the position of a ghost Artist, meaning that I will be behind the scenes and not seen publicly to have worked on the art without the client's permission.
Black List
Failure to meet my terms and conditions will place the person on my black list.
My black list is a list of users and people that I will no longer work with in the future or take work from.
I have the right to refuse any requests or commissions from a person on my black list.
Reasons you may be on the black list:
- You have used my art with, for or by AI purposes.
- You have posted my artwork without my permission.
- You have edited, used filters, recoloured, stolen, traced my artwork.
- You have used my artwork on products without my permission or a commercial or full license.
- You have purposely showed signs of imitating my work or directly copying from it.
- You have drawn my characters disrespectfully.
- You have stolen, used, sold my characters (This includes RP).
- You have not properly credited my artwork where needed (example: lack of credit for profile picture in bios and post descriptions etc
This includes all sites where my art is used including: Discord, YouTube, Twitch, Instagram, Twitter, DeviantART etc).
- You cropped the watermark or hidden the watermark from my piece with a personal, standard or requested license.
- You have harassed / bullied / stalked / showed dangerous behaviour towards me online or in person in the past.
- You have showed signed of harassing / bulling / stalking and dangerous behaviour towards other Artists or people online or in person.
- You have a history of being disrespectful towards creative indiviudals such as their prices, worth or work itself.
- You have a history of using AI on commissioned work and / or posting art without crediting.
- You have a history of tracing, recolouring, editing and / or putting filters on work which was not made for you.
I have the right to search all clients reputation and online public spaces before accepting commissions and work from them and to judge if they meet the criteria and are safe and respectful for me to work with them.
